By downloading, installing, accessing, or using the Loona Period Tracker mobile application ("App"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Loona provides a period tracking and women's health application that offers:

• Menstrual cycle tracking and predictions using artificial intelligence
• Health data logging and analysis
• Personalized health insights and recommendations
• Integration with Apple Health (optional)
• Local data storage with optional cloud backup

3. Medical Disclaimer and Limitations

Important Limitations:

• NOT for Contraception: Do not rely on Loona for birth control or family planning decisions
• NOT for Medical Diagnosis: The App cannot diagnose medical conditions
• Predictions are Estimates: Cycle predictions and fertility insights are estimates based on algorithms, not medical advice
• Always Consult Healthcare Providers: Seek professional medical advice for health concerns, family planning, or medical decisions

4. User Responsibilities and Acceptable Use

Your Responsibilities:

• Provide accurate and truthful information
• Use the App only for lawful purposes
• Maintain the confidentiality of your account credentials
• Keep your health data up to date
• Use the App responsibly and as intended

Prohibited Uses:

• Do not use the App for illegal purposes
• Do not attempt to hack, reverse engineer, or modify the App
• Do not share false or misleading health information
• Do not use the App to provide medical advice to others
• Do not violate any applicable laws or regulations

5. Account Security and Privacy

• You are responsible for maintaining the security of your account
• Notify us immediately of any unauthorized access to your account
• Use strong passwords and keep login credentials secure
• Your privacy is protected as described in our Privacy Policy

6. Subscription Terms and Payment

Free Tier:

• Basic period tracking features available at no cost
• Limited AI insights and predictions
• Local data storage only

Premium Subscription:

• Advanced AI-powered insights and predictions
• Unlimited cycle tracking and analysis
• Cloud backup and sync across devices
• Priority customer support

Billing and Renewal:

• Premium subscriptions are billed through your Apple ID
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can cancel anytime through your Apple ID account settings or App Store
• No partial refunds for unused portions of subscription periods

Refund Policy:

• Refund requests must be made through the Apple App Store
• We follow Apple's standard refund policies
• Refunds are at Apple's discretion and subject to their terms
• Contact Apple Support directly for refund inquiries

7. Data Ownership and Intellectual Property

Your Data:

• You retain all rights to the personal health data you input into Loona
• We do not claim ownership of your personal health information
• You can export, modify, or delete your data at any time

App Intellectual Property:

• Loona, its content, features, and functionality are protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, distribute, sell, or lease any part of the App
• The Loona name and logo are trademarks owned by us

8. Limitation of Liability and Disclaimers

No Warranties:

Loona is provided "as is" and "as available" without warranties of any kind, either express or implied.

Limitation of Liability:

We are not liable for any damages arising from:

• Use or inability to use the App
• Medical decisions made based on App information
• Data loss, corruption, or unauthorized access
• AI prediction inaccuracy or failure
• Third-party services or integrations
• Indirect, incidental, special, or consequential damages

Maximum Liability:

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Age Requirements and Parental Consent

• You must be at least 13 years old to use Loona
• If you are between 13-18, you should review these Terms with a parent or guardian
• Parents/guardians are responsible for monitoring their children's use of the App

10. Termination

Your Right to Terminate:

• You may stop using the App at any time
• Delete your account through Profile > Settings > Delete Account
• Upon account deletion, all data is permanently removed within 30 days

Our Right to Terminate:

• We may terminate or suspend accounts for violations of these Terms
• We may discontinue the App or certain features with reasonable notice
• Upon termination, your right to use the App ceases immediately

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

• In-app notification
• Email notification (if you have an account)
• Posting updated Terms on our website

Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
